ONE YEAR PARTS AND LABOR WARRANTY


In the event of failure or operational problem of a covered product, DesignJet USA  technical support team will provide service by means of telephone support
or, if necessary, replace the defective product, without charge for labor, service fees, and parts to the customer during the coverage period.

STEPS TO FOLLOW IF YOU NEED SERVICE :

a)        In the event that the product manual and troubleshooting guides do not provide the customer with the means to correct covered
product problem, the customer must call the telephone number for customer service support printed on the customer information section of
this Extended Service Agreement. Customer service representatives will be available Monday thru Friday from 9:00 a.m to 5:00 p.m MST,
holidays excepted. The Customer and a DesignJet USA technician will converse by telephone to efficiently correct any covered product  technical issues.

b)        In the event that the telephone support by a DesignJet USA technician does not, in our opinion, correct the covered product technical  issue, DesignJet
USA technical services will make commercially reasonable efforts to respond to requests for on-site service to the covered
product location indicated in the customer Information section of this agreement within times shown below. In the event we cannot locate a
suitable certified local technician within twenty miles of your zip code, we reserve the right to activate a replacement warranty. Customer must keep the
crate that the product was sent in for the first year of warranty. Customer must use the aforementioned crate to ship back defective product to
us at our (DesignJet USA) cost.

* Response Time : 9:00 a.m to 5:00 (MST) Monday thru Friday, excluding holidays. DesignJet USA will make every effort to provide same day
service if possible, depending on amount of calls logged. Service contract holders have priority over non-contract holders for service
response time.


What is not covered by this Service Agreement :

a)        Consumer replaceable product items / parts including paper, ink, toners, and maintenance kits.

b)        Product failures or problems due to corrosion, rust, dust, animal or insect damage, or weather damage.

c)        Product failures or problems due to conditions beyond DesignJet USA technician  control, such as damage from any unauthorized
repair, software virus, electrical, wiring, lack of surge protector, theft, civil disorders, utility accidents, and acts of nature such as lighting,
flood, fire, water, windstorm, hail, earthquake, and other natural occurrences.

d)        Product failures or problems due to failure to follow manufacturer’s recommended installation, usage, maintenance, and cleaning.

e)        Product failures or problems in any way caused by software or network issues.

f)        Service of any product that has been damaged, abused, or misused.

g)        Service of any product that has received unauthorized repair, modification, or service.

h)        Any cosmetic painting or refinishing.

i)        Service to any accessories.

j)        Product failures or problems due to the failure to use specified product parts or supplies such as toners or paper.

k)        Application software support or any application software support.

l)        Service of any product located in a site that has not met environmental specifications specified by the manufacturer.

m)        Service of any product not specifically covered by this Agreement with a problem caused by a covered product.

n)        Any software, hardware, or equipment not specifically listed in the Customer Information section of this Agreement.


Coverage period :

The coverage period begins on the date that you receive product from shipper. The length of  coverage is 12 months from that date.


Customer Responsibilities :

a)        The customer shall operate covered product in strict accordance with all the  manufacturer’s specifications.

b)        The customer shall properly use and maintain consumer replaceable products as specified by the covered product manufacturer.

c)        The customer shall be responsible for procurement, installation, and maintenance of all non-product media and equipment related to
the covered product including, but not limited to, telephone and cable equipment for remote transmission of data, software, and network
equipment.

d)        In the event of an on-site service call during business hours, the customer shall permit a DesignJet USA employee or contract
employee immediate full and safe access and use of any customer equipment or facilities that DesignJet USA deems necessary for the
performance of service.


DesignJet USA  Responsibilities :

a)       DesignJet USA shall provide a certified manufacturer technician to perform service as specified in sections 1 and 2 during the
coverage period.

b)        In the event of an on-site service, DesignJet USA employees or contract employees will comply with all regulations, policies, and
procedures in effect at customer location and facilities.

c)       DesignJet USA employees shall not disclose to any third party any information obtained from the customer that is expressly of a
confidential nature.


TERMINATION :

Either party may, at any time, terminate this Agreement by written mutual consent.
DesignJet USA may terminate this Service Agreement upon written
notice to the customer for any of the following reasons:

a)        Any breach of this Service Agreement by customer or any defaults on the part of the customer in its obligations as set forth in this
Service Agreement that has not been cured within 30 days after notice from DesignJet USA Service Dept.

b)        Any failure by the customer to make any payments due to DesignJet USA when due under terms of Agreement.

c)        A voluntary or involuntary bankruptcy is filed on behalf of the customer, or the customer becomes insolvent, or the customer becomes
under the control of a receiver, or the customer makes an assignment for the benefit of creditors.

d)        The customer has moved the covered product from the customer site location indicated in the Customer Information section of this
Service Agreement without written notice to DesignJet USA Service Dept.

e)        Any attempted re-assignment of this Agreement by the customer without written consent of DesignJet USA Service Dept.

f)        The customer may terminate this Agreement in the event that the DesignJet USA has breached a material condition of this Agreement
and had not cured such breach within thirty (30) days after receipt of written notice from the customer.


Limitation of liability :

In no event shall DesignJet USA be liable for any direct, indirect, actual,
special, incidental or consequential damages, including lost profits and personal
injury, arising out of any service provided under terms of this Agreement, even if  DesignJet USA had advance notice of, or should have
known of the possibility of any
such damage, except for damages caused by the gross negligence of DesignJet USA Service Dept. In addition, DesignJet USA shall not be
liable for any lost data, information, which may have resulted from, any service provided under terms of  this Agreement. DesignJet USA
shall not be liable for any interruption in the
operation of the customers business, the results of any failure to render services
within the time frame requested by the customer and problem or damage
resulting in any way by causes beyond the control of DesignJet USA

Indemnity :

The customer will indemnify and hold DesignJet USA harmless from, and against any third party claims, liabilities, damages, losses,
injuries, and costs arising out of any service performed by DesignJet USA under terms of  this Agreement or with any regard to any covered
product, including product
liability claims, with the exception of any claims arising from negligent acts of DesignJet USA .


Entire Agreement :

This Document, any attachments and any mutually executed additional attachments shall constitute the entire Agreement between the
parties with regard to the subject matter contained herein. All prior negotiations, discussions, representations, agreements relating to the
same subject matter are superseded by this Agreement, which Agreement shall not be modified except by both parties in writing.


Notices :

All notices required or specified in these terms and conditions shall be in writing
and shall be deemed effective upon receipt. Notices to DesignJet USA

Governing Law :

The parties agree that this Agreement and its terms and conditions shall be
construed according to the laws of the state of  Colorado and any action to
enforce its terms and conditions shall be brought forth in the courts of
Denver, Colorado.
Returns Policy:

You may return unopened items sold and fulfilled by DesignJetUSA.com within 30 days of delivery for a full refund. We'll also pay the return shipping costs if
the return is a result of our error.

If the item is opened, used, or returned because of customer error, customer will be responsible for return freight shipping cost.

Customer will also be responsible for opened and used consumables such as ink or paper and will be charged 50% of the cost of ink or paper.

Items should be returned in their original product packaging. Please keep the crate is was delivered in for at least 30 days or longer if possible.

By purchasing and accepting delivery of your item you accept the terms of our return and trade-in policy.

Receiving a Refund or Trade Credit:

We'll issue a refund after we receive and process your return or trade credit. You can expect your refund within 4 weeks of the return. (though in many cases
you'll receive the refund sooner).

This time period includes:

•  5 to 10 business days for us to receive your return or trade from the shipper
•  3 to 5 business days for us to process your return or trade credit
•  The time it takes your bank to process our refund or trade credit request (see below for specific guidelines)

We'll notify you via e-mail of your refund once we've received and processed the returned or trade item.

If the return and refund do not appear in your account within 4 weeks from the day you sent us your return or trade, please contact us for help.
